Veilleur

Terms of service

Veilleur's terms, in plain words

These terms apply to Veilleur's free check and to its paid plans. They are written to be read. If a sentence is unclear, write to us.

1. Who provides the service

Veilleur is a service of Operanto Technologies inc., a business corporation constituted in Quebec (NEQ 1182602574), 200-4388 rue Saint-Denis, Montréal, Quebec H2J 2L1. For any question, write to [email protected]. In these terms, "we" means Operanto Technologies inc. and "you" means the business that uses Veilleur.

2. What Veilleur does

Veilleur automatically observes the public pages of a website, and the PDFs they link to, and compares them with rules drawn from the Charter of the French language and from the Act respecting the protection of personal information in the private sector (Law 25). It also points out, without scoring them, whether AI engines can read the site, and a few neighbouring obligations visible online (Canada's anti-spam law, the Consumer Protection Act). It produces a dated report that quotes, for each finding, the text and the page element concerned.

Each plan includes what the Pricing page describes at the time of purchase.

3. What Veilleur does not do

Veilleur is an automated observation tool. It does not guarantee that your site complies, it is not legal advice and it does not replace a review by a lawyer. Whether a finding is an offence depends on facts a robot cannot see, starting with whether the business has an establishment in Quebec. Results depend on what the robot can see: it respects robots.txt and does not visit pages behind a login. A problem missing from the report is therefore not proof that it does not exist. Nor does Veilleur guarantee that an AI engine reads, shows or cites your site: its answers change from one time to the next and depend on its provider. You remain responsible for your site's compliance, and a fine or an order aimed at you remains yours.

4. Who Veilleur is for

Veilleur is for businesses, for the purposes of their business. By paying, you confirm you act for a business. A paid plan may only cover a site you own or manage under a mandate from its owner. We may suspend or end the access of a business that does not respect these terms, for example by monitoring a site without authorization, getting around the free check's limits or not paying. Except in a case of obvious abuse, we write to you first so you can correct the situation.

5. Plans and prices

Prices are in Canadian dollars. Applicable taxes are added, if any.

6. Billing

Payment is by card, through Stripe. We never see your card number. You accept these terms by ticking the box provided when you pay. The Agency plan is agreed in writing, on invoice: each of its invoices refers to these terms, and paying the first one means accepting them. Monthly monitoring is billed in advance every month, yearly monitoring in advance every year, and both renew until cancelled. We write to you before each yearly renewal. If a payment fails, monitoring continues while Stripe tries again, then stops if the last attempt does not go through. Invoices are issued in French.

7. Cancellation and refunds

You can cancel monitoring at any time from the customer portal, reached through the "Manage subscription" link on every report of the site and in every monitoring email. Cancellation takes effect at the end of the paid period, the month or the year. Outside the guarantee below, a period already started is not refunded.

Money-back guarantee. If monitoring is not for you, write to us within 30 days of a site's first payment: we refund that payment in full, the first month or the first year, depending on the plan chosen, and the monitoring stops at once. The guarantee applies once per business and per site. It does not apply to the audit or to the Agency plan.

The audit is refunded in full if it cannot be carried out, for example if the site is unreachable or blocks the robot. Once the report is delivered, the audit is not refundable. If the review of the quality of the French could not be done during the audit, we redo it at no charge as soon as possible, and the completed report is sent to you.

The month of monitoring included in the audit starts the day after the purchase and ends by itself 30 days later. It is not billed and does not renew: nothing is charged at the end. Five days before the end, we write to tell you how to extend it, if you want to. It is offered once per site. To stop it earlier, reply to one of its emails.

We may end a paid plan for a serious reason other than a breach on your part, for example the end of the service, with 30 days' notice by email. We then refund the paid part that will not have been served.

Nothing in these terms limits a right the law gives you.

8. Availability

We make reasonable efforts to keep Veilleur running without interruption, without guaranteeing a service level. Maintenance or an outage can interrupt the service or delay a check. If the review of the quality of the French cannot be done on a given day, each page keeps the grade of its last reading, those without one yet wait for theirs, Veilleur asks again by itself for three days, and the report says so.

9. Your data

The Privacy page explains what we collect and who we entrust it to. Free checks are deleted after 90 days. Reports of a monitored site are kept while the monitoring lasts, then twelve months. An audit report is kept twelve months. We may use the findings Veilleur produces, in an aggregated form that names neither you nor your site, to improve its rules and describe the state of the market.

10. Intellectual property

The software, the Veilleur brand and the content of this site belong to Operanto Technologies inc. or to those who license them to it. You may use the reports for your business, including sharing them with your web team or agency.

11. Liability

Our liability to you is limited to the amounts you paid us in the twelve months before the claim. If you only use the free check, this limit is $0. We are not liable for indirect losses. These limits apply only as far as Quebec law allows: they do not exclude our liability for intentional or gross fault, or for bodily or moral injury.

12. Changes to these terms

We publish any change on this page, with its date. If you have a paid plan and a change affects you, we write to you at your payment address 30 days before it applies, and you can then cancel. If you paid for a year, we then refund the whole months left. A change does not alter the price of a period already paid.

13. Governing law and courts

These terms are governed by the laws of Quebec. The courts of the judicial district of Montréal have jurisdiction. If a clause of these terms is held invalid, the others continue to apply.

14. Language

This English version is provided for convenience. The French version governs.
